The publication of the election results protocols at the polling stations should be enforced. Results should be displayed outside and not inside the polling centres as soon as the polling station committee operations have finished.

The election administration must ensure that all technical (i.e. computers) and human resources are available and functioning in order to meet the legal deadline for the tabulation to be completed.

The simplification of the system is necessary in order to reduce risks of mistakes at different levels, speed up the counting operations and announcement of electoral results and, by doing so, increase the general trust from the public.

Special arrangements should be made to facilitate the vote of special categories of voters on duty on election day such as electoral staff, armed forces and police and to organize special voting for patients in hospitals and sanatoria (as well as prisoners).

The voter lists for the polling stations should contain a place for the voter to sign or put down a thumb mark as a safeguard against ballot paper stuffing. ECK regulations should stipulate counting the voters’ signatures on the voter lists and reconciling this resulting total with the number of ballot papers in the ballot boxes.

Clear provisions should define the validity or invalidity of a ballot paper found in the wrong ballot box.

The ECK should develop a time-frame for the announcement of results in order to avoid increasing tension due to delays and uncertainties in announcing results.

It is advisable that STAE analyse the impact of the repositioning of voting booths during the 2012 Parliamentary election with a view to striking a balance between the transparency of voting procedures and the right to secrecy of the vote which must be guaranteed under all circumstances.

It would greatly increase the transparency of the counting process if STAE allowed copies of results sheets signed by the Voting Centre Presidents and Polling Station Secretaries to be given to all party agents present during the counting. An explicit requirement in the regulations that party agents and observers present in the district tabulation centres have access to the reception, verification, reconciliation and digitisation of the voting centre results sheets would diminish the scope for arbitrary rulings on the layout of tabulation centres and would greatly enhance the credibility of the tabulation. The EU EOM suggests that the electoral authorities adopt the practice of publishing on its website the election results broken down to voting centre level, or polling stations in the future, as soon as the final results are certified by the court, to enhance the transparency of the electoral process. More generally, STAE and CNE could increase public awareness and oversight if they devoted more resources to the prompt publication on their websites of new regulations, decisions and initiatives.

Il serait souhaitable que le Conseil constitutionnel expose clairement et en détail les motifs de ses décisions (faits, demandes, règles applicables, délibérations, etc). La totalité des décisions électorales du Conseil constitutionnel devrait être publié en temps réel sur son site Internet.

Il conviendrait d’amender le Code électoral afin que tout électeur, à l’étranger comme au Sénégal, puisse utiliser pour voter au besoin son passeport au lieu de sa CNI, étant donné que les nouveaux passeports biométriques sénégalais intègrent les données contenues dans les CNI.

Considérant les débats portant sur le bulletin unique, déjà avancés lors de la révision du Code électoral en 2011, la MOE UE estime que l’introduction de cette méthode de vote devrait être planifiée selon un calendrier suffisant pour s’assurer de la prise en compte des défis techniques et d’une sensibilisation appropriée des électeurs.

Les expériences acquises par le ministère en charge des élections en matière de remontée des résultats officieux, à partir de BV «témoins», devraient permettre à l’administration électorale, avec les parties prenantes, de proposer aux médias un moyen consensuel d’annonce de la projection des résultats des scrutins nationaux, lors des soirées électorales.

Il est nécessaire que les résultats préliminaires détaillés par BV soient affichés dans les centres de compilation et mis en ligne immédiatement sur le site Internet de l’administration électorale. Celle-ci devrait aussi élaborer et diffuser des procédures pour la gestion des erreurs sur les procès-verbaux définissant un taux de discordance acceptable et des procédures de quarantaine, de recomptage et d’audit pour les BV ayant dépassé ce taux.

An increase in planning, inventory design and recording of delivery and arrival of electoral material systems, as well as addressing transport, logistics and human resource management issues, would better ensure the minor problems observed in these areas for the 2011 elections do not recur. Checklists could be introduced at all levels to create adequate inventory systems as well as assist polling station level staff manage processes.

The Electoral Commission should have a statutory power to cancel a result or adjust a result according to narrow criteria or apply to court for such an order.

The arrival of results and their aggregation at the centres would be made more transparent if they were projected in real time on localised screens. A greater number of operators with specialised training on this part of the process would also increase the efficacy of the collection of results. The Electoral Commission could review the procedures used during this stage of the electoral process with a view to improving delivery times and transparency of aggregation.

The protection of ballots in ballot boxes should be enhanced by mandatory use of serialised seals. Moreover, ballot boxes made of less flexible material should be considered in order to render an easy extraction of ballots from the box impossible.

While the provisions for tendered ballots and objections to rejected ballots are certainly effective conflict mitigation measures at polling units, it would be worthwhile to elaborate further procedures related to the scrutiny and re-examination of such ballots at higher collation levels.
