In general terms, the management capacity of the DNR has to be improved. The department would need this assistance to identify the real needs, to plan its activities, to decide about the specifications of the items to be supplied, to participate in the procurement process and in the drafting of the tender documents. A better co-operation between ECZ and DNR has to be promoted, in order, beyond that co-operation, to achieve a possible integration of the national registration with the voter registration system. For instance, sharing computer resources should be considered

The question of issuance of National Registration cards (identity cards) has to be tackled seriously. A consistent plan should be proposed to bring about an adequate and final solution to the problem in providing a full support to the Department of National Registration. The Department of National Registration still seems to be under-equipped and to suffer from a lack of methodology and management capacity. Some kind of technical assistance to be provided to this office should be proposed and discussed.

A related issue to that of voter rolls is that of availability, conservation and replacement of identity cards. This has been a serious problem in the past, and may again be as serious and costly in the near future. (…) The punching of identity cards has most likely created a new problem –and a very costly one– without necessarily being the main solution to the problem it was meant to solve, that of double voting.

The main problem with the voter lists is that they are not properly updated. (….) While there are no quick-fix solutions to the problem of updating the voter rolls, improving the way in which death certificates are produced at the municipality level and then transmitted to the electoral administration seems of the utmost importance in Nicaragua. Since the CSE at the same time administers the general civil register, voter register reforms would need to take into account the inadequate connections between different branches of the register system in different parts of the country.

The voting register requires further improvement and updating. It was further observed during polling day that polling staff experienced difficulties finding voters names on the register particularly when the voter did not carry the slip given to them by political parties. This resulted in long queues at busy polling stations. As the register is now computerised, names should be listed in a uniform way to facilitate staff in finding the respective names of voters.

It is clear that the current voters register is seriously flawed. Whilst these serious flaws did not materially affect the result of this presidential election, if not corrected they may well materially affect the result of a future presidential election where the majority of the winning candidate over the losing candidate is narrower. The ECK must address this issue urgently. It is recommended that the ECK meets with the international community to discuss how to improve the accuracy and integrity of the register, using the imminent introduction of continuous voter registration.

The fundamental deficiencies in the voter registration system should be addressed as a matter of urgency. This can be implemented by either using census data (1) or developing the active system of registration currently in use. (1) Introducing a passive system of registration based on census data: the data is in electronic form and is currently collected every 10 years. To provide an adequate basis for a voter list, the census would need to be rolling or updated every year. (2) If the system of an on-going active registration is maintained, rather than creating an entirely new register each year, the one from the previous year should be used as a basis from which adjustments (additions/deletions) are made.

The inconsistency between the Constitution and the Registration of Electors Act should be clarified to enable all citizens who have reached 18 years of age to be able, not only to register, but also to vote. Due to the flexibility over potential electoral dates, the EU EOM recommends that Sri Lankans be able to register at 17 years. The birth date should be included in the voter register so voters would only be able to vote when reaching 18 on the day of the elections. This would ensure that if an election falls before the next enumeration phase, those having attained the age of 18 would be able to exercise their right to vote.

The EU EOM observed that many of the problems that had been identified by various civil society organisations in the REP are due to the civil registration and ID Card system. For the CNE to win over the trust of the citizens in the electoral register, the integrity of both these systems must be ensured. To this end, it suggests that joint actions be organised between the offices responsible for the civil register, the electoral register, and the ID Cards to tidy, update, and restore the integrity of the respective databases in a synchronised manner.

Identification requirements for voter registration should be improved in cooperation with the implementation of a national census or civil registry. The majority of Guinean citizens do not hold an identity card or birth certificate. Registration of voters, mainly in rural areas, is generally only made possible with the use of witnesses. The AFIS project could also be considered as a tool for civil registry.

The voter registration process should be upgraded from manual to an Automated Fingerprint Identification System (AFIS), already used in many countries in Africa, especially in post-conflict environments, to facilitate and speed up registration through a possible active and passive process, whereby citizens go to places of registration and brigades (brigadas de recenseamento) visit their places of residence. The voter registration process for the 2008 legislative election, however accepted by all political parties and stakeholders, showed a very low participation (around 35 percent) and motivation of citizens, especially youngsters (3.8 percent), in comparison to same exercises in other countries in the area.

Overall voter registration activities should be under the exclusive control of the Election Management Body. Shared institutional responsibility between the government and the independent election body creates areas of friction and has the potential to impair the CNEs capacity to independently conduct the polls. For instance, the CNE, the supervisory body with overall responsibility for organizing elections, does not have the legal mandate to manage the critical voter registration process which falls under the responsibility of the Government. Changes to the law should be introduced to allow the CNE control of the entire cycle of production of the voters’ list alongside the introduction of a systematic and permanent yearly voters’ update as foreseen in the electoral law. The CNE and CREs should have full mandate to carry out all voter registration hence strengthening its independency and the neutrality of the register. CRE’s would need to have a permanent structure in order to allow for full electoral cycle activities.

In conjunction with the development of the national identity card scheme the voter register should be overhauled and a greater degree of centralisation introduced in ample time for entries to be checked and if necessary removed. The parties should also receive copies of the register well in advance of elections, together with copies of all special, proxy and absentee registers at regional and national levels. These should also be displayed in public in the vicinity of polling stations.

An extensive review of the voter register and the voter register exercise should be undertaken. Digital technology with photographs and any other relevant identification should be developed. More adequate safeguards should also be introduced during registration to ensure minors of other individuals that are not eligible to vote are excluded from the register. A greater period of time should also be planned for public exhibition of the register and a permanent registration process should be considered.
