The following steps should be taken to improve procedures on election day:
i. The voter’s finger should be checked for ink before voting;
ii. Young voters’ cards should be checked to see if they are 17;
iii. Clear procedures should be produced on how to assist illiterate or disabled voters;
iv. Greater staff training and voter education on valid and invalid votes is needed to avoid inconsistency in the identification of invalid ones;
v. Ballot papers should be provided with numbered stubs to assist in accounting for them, as was done for the parliamentary elections;
vi. The polling station minutes (Actas de Operasaun) and any ballots not used (unused, cancelled) should be considered sensitive material.

The fact that the presidential and parliamentary elections took place this year with different counting procedures creates uncertainty as to which procedures will be used in future elections. The election procedures should be the same, whichever system is chosen. However, it is best practice to count as soon as possible after closing of polling and in the presence of all those directly involved; therefore it is preferable and more transparent to count at polling station level.

The election laws should be amended and the CNE should pass a regulation to ensure that the publication of results is detailed and accurate. In particular:
i. Copies of each polling station minutes (Acta de Operasaun) should be made available to candidate or party agents at the polling station.
ii. If counting takes place at polling stations, greater efforts should be made to ensure that the minutes are displayed at each polling centre immediately after the count.
iii. Detailed preliminary and final results should be published in due time in newspapers, announced to the media, and posted on the CNE’s website. An electronic copy on CDs could be made available to candidates and parties and to observers. A clear explanation should be given of the tabulation process, and why results may change during district and national tabulation.
iv. When publishing partial, preliminary or final results the CNE should publish all available data, including results for all candidates, the total number of votes cast, and the number of invalid ballots.
v. When publishing preliminary or final results, the results should be broken down by district and polling station.
vi. Candidates and parties should be given the detailed breakdown of preliminary results as soon as they are announced, because they only have 24 hours to present an appeal against them.

To make the electoral system more robust and improve the integrity of future elections some preparatory and procedural adjustments might be considered, such as:
?? timely distribution of materials so any mistakes and omissions could be dealt with;
?? the serial numbering of result and aggregation forms used at each counting and aggregation level;
?? procedures in polling stations should be streamlined and training provided to ensure that polling stations staff know what has to be done and why;
?? ensuring that two copies of final voters’ lists (FVLs) are prepared, distributed and allocated to all polling stations (one for public display and one to tick off the voters who received ballot papers);
?? stressing the importance of securing ballot papers and other sensitive election material at all times;
?? strict enforcement of voter identification, including a systematic check for ink and subsequent inking;
?? assuring the secrecy of vote, by locating voting booths in an appropriate manner;
?? improving polling, counting and aggregation procedures to eliminate duplication and simplifying the procedures where possible;
?? assuring the public display of official election results at all levels after counting or aggregation is completed; assuring a direct feed of results from polling station level to district aggregation centres to deter any attempt to manipulate successive aggregations of votes;
?? ensure a consistent application of all rules and regulations.

(ii) DEOs should publish the results protocols from polling stations at the time they are submitted.
(iii) Partial and preliminary results should be published by the CEC and DEOs as soon as they are available.
(iv) When publishing preliminary or partial results, the CEC should publish all available data, including results for all candidates, and results broken down by polling station. The Electoral Law could be amended to detail exactly what information should be published. If publishing partial results, the CEC should clearly identify them as such and provide explanations for any changes.

Electoral procedural safeguards have been introduced effectively improving the polling process, yet election staff is not always aware of the meaning or importance of upholding certain electoral principles. A number of shortcomings were noted and some election procedures were differently implemented as was the case of the incorrect positioning of the voting booth inside the polling station that in several instances compromised the secrecy of the ballot. Procedural details regarding the key stages of the aggregation, transmission and announcement of results should be clear and unambiguous. It is therefore advisable to strengthen training of lower level election staff while procedural manuals are made largely available to election staff and stakeholders far before election day.

The use of trained personnel sent from the NEBE headquarters to assist and possibly digitalise certain elements of the consolidation process could be considered.
