Les procédures de consolidation et de transmission des résultats doivent être établies et rendues publiques.

Les résultats par BV doivent être affichés dans tous les BV à la fin du dépouillement. De même, tous les procès-verbaux des compilations successives des résultats au niveau de la commune, du département et de la région. Ces résultats devraient immédiatement être publiés en ligne sur le site Internet de la CENI. Celui-ci doit être mis à jour et utilisé comme canal d’information privilégié. Pour cela, des moyens et des formations informatiques supplémentaires sont nécessaires.

Les procédures de vote devraient être uniformisées, notamment utilisant le bulletin unique si deux scrutins se déroulent en même temps.

The future EMB should promote the secrecy of vote as paramount in voting processes. To facilitate this, sturdy voting screens should be procured that guarantee that no voter’s ballot can be viewed during the marking phase. Polling officials should provide only the most rudimentary advice with regards to informing voters (particularly elderly and illiterate voters) on how to mark their ballots.

The proliferation of candidates as Uganda’s multi-party system becomes entrenched renders the use of washing basins in open-air polling stations ineffective as a means of ensuring secrecy of vote. Facilities provided in other countries, including regionally, are more effective in this regard and merit timely consideration.

Granting the High Court sole competence to order and conduct parliamentary recounts would guarantee procedural integrity and adequate protection of evidence.

Réglementer les modalités précises de la centralisation des résultats au niveau de la circonscription afin d’augmenter la transparence et l’authenticité des résultats. Le rapport de centralisation devrait être formalisé dans un PV unique pour tout le pays et établi par la CENI.

The Election law and regulatory provisions should include requirements for:
a) consistent verification of voters’ identification;
b) the names of candidates to be mentioned on the ballot for the single member constituency race;
c) allowing voters who have spoiled a ballot to be issued a new one;
d) enhanced reconciliation procedures at the end of polling, e.g. between the number of ballots used and the number of names marked in the voter list;
e) allowing party/candidate agents and accredited observers to enter comments in protocols at all stages of the voting and counting processes;
f) certified copies of polling station inventory forms and constituency results protocols to be distributed to all involved stakeholders, including party/candidate agents and accredited observers.

The ECP should ensure that all polling station statement of counts are given to agents and observers and are immediately displayed.

The ECP should undertake a review of its regulations and procedures and make amendments accordingly. All forms should be reformatted to ensure that they contain complete information, and are easy to use and to submit electronically for fast and complete data compilation at the central level.

Postal voting procedures and practices should be reviewed to promote uptake of this provision by those eligible.

Compilation and consolidation should be merged into one process. This would require the validity of ballots to be determined by presiding officers during the count at the polling station, and the deadline for receipt of postal ballots to be the scheduled for the close of polling on election day (for immediate inclusion in the constituency aggregation on election night).

The ECP should take active steps to address participation by people traditionally marginalised in the process, for example, women, the disabled, internally displaced persons and nomadic people. This should include an outreach programme for voter registration, due consideration in polling station identification, and consideration of extended use of postal balloting.

The EU EOM also recommends that in order to make the right to vote more effective, certain mechanisms should be introduced, to allow for its practical exercise by Guatemalan citizens who reside abroad. Measures could also be implemented to enable the vote for hospitalised citizens, or those who cannot physically transport themselves to the polling centres due to medical reasons, together with imprisoned citizens awaiting trial who have yet to be condemned, and members of the National Police and the Army who may be on duty during election-day.

The Electoral Act should be amended to provide more detailed provisions for voting, counting and collation procedures. These should include:
(i) a requirement for results to be publicly displayed at polling stations immediately after counting has been completed;
(ii) a requirement for copies of official result forms to be distributed to all involved stakeholders. including political parties, candidates and observers.
(iii) a requirement for detailed results broken down to polling station level to be publicly displayed at all superior levels of the election administration;
(iv) a requirement for INEC to swiftly publicly display, including on its website, detailed results of the elections, including all polling station results as well as collated information on the number of voters, votes cast, invalid votes etc.
(v) a requirement for results to be officially announced within a time limit of three days;
(vi) a requirement for voters, political parties and observers to be able to request a recount of ballots at polling station level when irregularities have been identified;
(vii) a requirement for INEC to be able to order a recount of ballots at polling station level if it is established that the law was violated; and
(viii) provision of clear grounds and authority to INEC to annul election results.

INEC should ensure that voting booths are distributed in sufficient time to all polling stations and all polling staff are trained to erect them and fully implement all procedures designed to ensure secrecy of the vote.

INEC should ensure that polling station officials adhere to provisions in the Electoral Act allowing voters waiting in line at the close of polling.

The election legislation should be revised to allow voters queuing at closing time to vote.

The training of the polling station committee members should emphasize the accurate completion of the results protocols and the determination of the validity of the ballots.

La conception des procès-verbaux de résultats peut encore être améliorée afin notamment d’accompagner et d’inciter de manière plus explicite aux réconciliations finales des chiffres (réconciliation des bulletins de vote utilisés et non utilisés avec le nombre de bulletins reçus ; réconciliation du nombre de bulletins trouvés dans l’urne avec le nombre des émargements sur la liste électorale). L’utilisation d’un système unique de codification des bureaux de vote peut contribuer à réduire le risque d’erreurs et à alléger la charge de travail à la fin d’une longue journée électorale.

Il convient de préciser les conditions et les modalités d’une annulation des résultats ou d’un nouveau décompte des bulletins de vote par les autorités administratives responsables.

Consideration should be given to the feasibility of results being tallied in a parallel process at district level for the next general elections. Procedures for how the National Tally Centre process ballots from polling stations that indicate irregularities should be improved. This includes rules for quarantining and invalidating individual results.

Citizens deprived of liberty but not convicted should be able to exercise their right to vote as underlined in the Comments 25 (14).

A safe system for mobile voting for incapacitated voters like the physically disabled, elderly, sick, pregnant and hospitalised should be considered.
