The paper – the first to be published under the new Brookings Doha Center-Stanford Project on Arab Transitions – concludes that while constitution writing must be treated as an organic process, the international community should work to ensure that Egypt’s military does not entrench a role for itself in domestic governance.
With parliamentary elections now complete, Egypt moves to the next major step in its fitful political transition -- drafting a new constitution for the republic. As the fundamental document establishing a framework for governance, the new Egyptian constitution will have a lasting effect on Egyptian law, politics, and society. However, Egypt’s transition is shaping up to be a case study in how not to initiate a constitution-writing process.
At a time when the shortcomings of a mismanaged transition threaten to undermine the constitution-writing process, author Tamir Moustafa identifies the most important issues to be tackled by the country’s Constituent Assembly. Focusing on questions that range from the place of Islamic law to women’s rights to the role of the military, he offers recommendations on how each area should be addressed.

Having witnessed the first competitive Post-Mubarak parliamentary elections, the Electoral Institute for Sustainable Democracy in Africa (EISA) was accredited by the Higher Presidential Elections Commission (HPEC) to deploy a Mission to witness the historic presidential election that took place on 23 and 24 May 2012 in the Arab Republic of Egypt.
The EISA Mission has made its assessment of the first round of the presidential election, and its preliminary observations, findings and recommendations are presented in this Interim Statement. EISA will produce a comprehensive final report on the presidential election upon the conclusion of the process.

The Carter Center election witnessing mission was accredited in Egypt by the Presidential Election Commission (PEC) on May 3, 2012. The mission included a total of 102 witnesses from 35 countries who visited 909 polling stations in 25 governorates to follow voting, counting, and tabulation. This statement is preliminary; a final report will be published four months after the end of the electoral process.

The Carter Center released on 14 Jan 2013, its recommendations for the upcoming parliamentary elections based on its observation missions for the 2011-2012 parliamentary and presidential elections. The Center suggests critical reforms in the following areas: voter education and information, women in the electoral process, electoral observation, internal and external communications, procedures and training, voter access and participation, electoral contestants (parties and candidates), and electoral legal framework. The recommendations come as the Shura Council is considering electoral legislation, and the election commission is preparing for the upcoming House of Representatives election. These recommendations are useful to Egyptian lawmakers and election authorities as they work to develop electoral laws and processes that are fully consistent with Egypt’s international obligations and commitments.
