Drafting Egypt’s New Constitution, Brookings Doha Center & Stanford University Project on Arab Transitions (2012)

The paper – the first to be published under the new Brookings Doha Center-Stanford Project on Arab Transitions – concludes that while constitution writing must be treated as an organic process, the international community should work to ensure that Egypt’s military does not entrench a role for itself in domestic governance.
With parliamentary elections now complete, Egypt moves to the next major step in its fitful political transition -- drafting a new constitution for the republic. As the fundamental document establishing a framework for governance, the new Egyptian constitution will have a lasting effect on Egyptian law, politics, and society. However, Egypt’s transition is shaping up to be a case study in how not to initiate a constitution-writing process.
At a time when the shortcomings of a mismanaged transition threaten to undermine the constitution-writing process, author Tamir Moustafa identifies the most important issues to be tackled by the country’s Constituent Assembly. Focusing on questions that range from the place of Islamic law to women’s rights to the role of the military, he offers recommendations on how each area should be addressed.

مع اكتمال الانتخابات البرلمانية ، تنتقل مصر الآن إلى الخطوة الرئيسية التالية في تحولها السياسي – وهي صياغة دستور جديد للجمهورية. بوصفه الوثيقة الأساسية لوضع إطار للحكم، سيكون للدستور الجديد تأثير دائم على القانون ، والسياسة، والمجتمع المصري. يمثل الدستور الجديد فرصة فريدة للمصريين لإعادة تشكيل السلطة السياسية، وتكريس الحقوق الأساسية، وإعادة هيكلة عمليات الحكم.

Egypt: Interim Statement by EISA Election Witnessing Mission to the Presidential Election, EISA (2012)

Having witnessed the first competitive Post-Mubarak parliamentary elections, the Electoral Institute for Sustainable Democracy in Africa (EISA) was accredited by the Higher Presidential Elections Commission (HPEC) to deploy a Mission to witness the historic presidential election that took place on 23 and 24 May 2012 in the Arab Republic of Egypt.
The EISA Mission has made its assessment of the first round of the presidential election, and its preliminary observations, findings and recommendations are presented in this Interim Statement. EISA will produce a comprehensive final report on the presidential election upon the conclusion of the process.

قام مركز كارتر في 14 كانون الثاني / يناير 2013، بنشر توصياته بشأن الانتخابات البرلمانية القادمة بناء على بعثتيه لمتابعة الانتخابات البرلمانية والرئاسية في 2011-2012. ويقترح المركز القيام بإصلاحات هامة في المجالات الآتية: توعية الناخبين والمعلومات، والمرأة في العملية الانتخابية، ومراقبة الانتخابات، والاتصالات الداخلية والخارجية، والإجراءات والتدريب، ووصول الناخب و مشاركته، والمتنافسون (الأحزاب والمرشحون)، والإطار القانوني للانتخابات. وتأتي هذه التوصيات في إطار أن مجلس الشورى ينظر الآن في وضع قانون للانتخابات وأن لجنة الانتخابات تستعد منذ الآن لانتخابات مجلس النواب المقبلة. ويأمل المركز في أن تكون هذه التوصيات ذات فائدة للمشرعين المصريين والسلطات الانتخابية وهما الآن بصدد تطوير قوانين الانتخاب والعمليات الانتخابية التي تنسجم تماما مع التزامات مصر الدولية.

The Carter Center released on 14 Jan 2013, its recommendations for the upcoming parliamentary elections based on its observation missions for the 2011-2012 parliamentary and presidential elections. The Center suggests critical reforms in the following areas: voter education and information, women in the electoral process, electoral observation, internal and external communications, procedures and training, voter access and participation, electoral contestants (parties and candidates), and electoral legal framework. The recommendations come as the Shura Council is considering electoral legislation, and the election commission is preparing for the upcoming House of Representatives election. These recommendations are useful to Egyptian lawmakers and election authorities as they work to develop electoral laws and processes that are fully consistent with Egypt’s international obligations and commitments.

في الوثيقة المرفقة ﺍﻟﺘﻘﺭﻴﺭ ﺍﻟﻨﻬﺎﺌﻲ الصادر ن مركز القاهرة لدراسات حقوق الانسان، ﻟﺘﻘﻴﻴﻡ ﺃﺩﺍﺀ ﻭﺴﺎﺌل ﺍﻹﻋﻼﻡ ﺨﻼل ﺍﻻﻨﺘﺨﺎﺒﺎﺕ ﺍﻟﺒﺭﻟﻤﺎﻨﻴﺔ 2011-2012 ﻓﻲ ﻤﺼﺭ، ﻭﺍﻟﺫﻱ ﻴﻭﻀﺢ ﻜﻴﻔﻴﺔ ﺘﻨﺎﻭل ﻭﺴﺎﺌل ﺍﻹﻋﻼﻡ ﺍﻟﻤﺨﺘﻠﻔﺔ ﻟﻠﻌﻤﻠﻴﺔ ﺍﻻﻨﺘﺨﺎﺒﻴﺔ. ﻭﻴﺄﺘﻲ ﺫﻟﻙ ﻓﻲ ﺇﻁﺎﺭ ﺭﺼﺩ اﻠﺘﻐﻁﻴﺔ ﺍﻹﻋﻼﻤﻴﺔ ﻟﻼﻨﺘﺨﺎﺒﺎﺕ ﺍﻟﺒﺭﻟﻤﺎﻨﻴﺔ ﻀﻤﻥ ﺍﻻﺌﺘﻼﻑ ﺍﻟﻤﺴﺘﻘل ﻟﻤﺭﺍﻗﺒﺔ ﺍﻻﻨﺘﺨﺎﺒﺎﺕ ، ﺨﻼل ﺍﻟﻔﺘﺭﺓ ﻤﻥ 12\10\2011 ﻭلغاية 15 ﻴﻨﺎﻴﺭ 2012. تقوم ﻤﻨﻬﺠﻴﺔ ﺍﻟﺘﻘﺭﻴﺭ ﻋﻠﻰ ﺘﻘﺴﻴﻡ ﺍﻟﻌﻤﻠﻴﺔ ﺍﻻﻨﺘﺨﺎﺒﻴﺔ ﺇﻟﻰ ﺜﻼﺙ ﻤﺭﺍﺤل ﺭﺌﻴﺴﻴﺔ. ﺍﻟﻤﺭﺤﻠﺔ ﺍﻷﻭﻟﻰ ﻫﻲ ﻤﺭﺤﻠﺔ ﺘﺴﺠﻴل ﺍﻟﻤﺭﺸﺤﻴﻥ ﻭﺘﺸﻜﻴل ﻟﺠﺎﻥ ﺍﻻﻨﺘﺨﺎﺏ "ﻤﺭﺤﻠﺔ ﻓﺘﺢ ﺒﺎﺏ ﺍﻟﺘﺭﺸﻴﺢ". ﺍﻟﻤﺭﺤﻠﺔ ﺍﻟﺜﺎﻨﻴﺔ ﻫﻲ ﻤﺭﺤﻠﺔ ﺍﻟﺤﻤﻼﺕ ﺍﻻﻨﺘﺨﺎﺒﻴﺔ ﺃﻭ ﻤﺎ ﻴﺴﻤﻰ ﺒﻤﺭﺤﻠﺔ "ﺍﻟﺩﻋﺎﻴﺔ ﺍﻻﻨﺘﺨﺎﺒﻴﺔ" ﻭﻫﻰ ﺍﻟﻤﺭﺤﻠﺔ ﺍﻷﻜﺜﺭ ﺃﻫﻤﻴﺔ ﺒﺎﻟﻨﺴﺒﺔ ﻟﻠﻤﺭﺸﺢ ﻭﺍﻹﻋﻼﻡ. ﺃﻤﺎ ﺍﻟﻤﺭﺤﻠﺔ ﺍﻷﺨﻴﺭﺓ ﻓﻬﻲ ﻤﺭﺤﻠﺔ "ﺍﻻﻗﺘﺭﺍﻉ ﻭﻓﺭﺯ ﺍﻷﺼﻭﺍﺕ" ﻭﻫﻲ ﺍﻟﻤﺭﺤﻠﺔ ﺍﻷﻫﻡ ﺒﺎﻟﻨﺴﺒﺔ ﻟﻠﻨﺎﺨﺏ، ﻭﺍﻟﺫﻱ ﺘﻨﻌﻜﺱ ﻓﻴﻬﺎ ﺘﺄﺜﻴﺭﺍﺕ ﺍﻹﻋﻼﻡ ﻭﻏﻴﺭﻩ ﻤﻥ ﻋﻭﺍﻤل ﺍﻟﺩﻋﺎﻴﺔ ﻋﻠﻰ ﺼﻨﺩﻭﻕ ﺍﻻﻗﺘﺭﺍﻉ. ﺨﻼل ﻋﻤﻠﻴﺔ ﺍﻟﺭﺼﺩ ﻋﻘﺩ ﻤﺭﻜﺯ ﺍﻟﻘﺎﻫﺭﺓ ﺜﻼﺜﺔ ﻤﺅﺘﻤﺭﺍﺕ ﺼﺤﻔﻴﺔ ﻭﻗﺩﻡ ﺨﻤﺴﺔ ﺘﻘﺎﺭﻴﺭ ﻤﺭﺤﻠﻴﺔ (ﺍﻟﺘﺭﺸﻴﺢ، ﺍﻟﺩﻋﺎﻴﺔ، ﻤﺭﺍﺤل ﺍﻻﻗﺘﺭﺍﻉ ﺍﻟﺜﻼﺜﺔ) ﻭﻴﺤﺘﻭﻱ ﻫﺫﺍ ﺍﻟﺘﻘﺭﻴﺭ ﻋﻠﻰ ﺍﻟﻨﺘﺎﺌﺞ ﺍﻹﺠﻤﺎﻟﻴﺔ ﻟﻠﻌﻤﻠﻴﺔ ﺍﻻﻨﺘﺨﺎﺒﻴﺔ ﻜﻜل، ﻭﺍﻟﻤﺅﺸﺭﺍﺕ ﺍﻟﻤﺠﻤﻌﺔ ﺨﻼل ﺍﻻﻨﺘﺨﺎﺒﺎﺕ ﻟﻜل ﻭﺴﻴﻠﺔ ﺇﻋﻼﻤﻴﺔ، ﻜﻤﺎ ﻴﺭﻓﻕ ﺒﺎﻟﺘﻘﺭﻴﺭ ﻤﻠﺨﺼﺎﺕ ﺍﻟﺘﻘﺎﺭﻴﺭ ﺍﻟﻤﺭﺤﻠﻴﺔ ﺍﻟﺘﻲ ﺘﺭﺼﺩ ﻨﺘﺎﺌﺞ ﺍﻟﻤﺭﺍﻗﺒﺔ ﺍﻟﻜﻤﻴﺔ ﻭﺍﻟﻜﻴﻔﻴﺔ ﻟﻜل ﻤﺭﺤﻠﺔ ﻤﻥ ﺍﻻﻨﺘﺨﺎﺒﺎﺕ ﻋﻠﻰ ﺤﺩﺓ.

Egypt, Libya and Tunisia: Report on The Sub-Regional Forum on Women’s Participation in Post-Revolution Parliamentary Elections (2012)

This report aims at documenting the proceedings of the Sub-Regional Forum on Women’s
Participation in Parliamentary Elections in Tunisia, Egypt and Libya; the three Arab countries
which are going through a transition period to build democracy, since 2011, following the Arab
Spring revolutions. It presents comparative experiences, regional and international perspectives,
as well as the discussions and debates that revolved around them. The Forum, organized
by the United Nations Development Programme (UNDP) and the United Nations Entity for
Gender Equality and the Empowerment of Women (UN Women), brought together more than
120 participants from among policy and decision makers, legislators and national opinion leaders
from Egypt, Libya and Tunisia. It also included members of the committees for drafting
of legislations (constitution or electoral laws); government representatives; elected and nonelected
candidates (men and women); members from the main political parties; academia and
the media; civil society organizations; women election observers; as well as representatives of
international organizations. This varied group was selected to ensure the engagement of both
men and women to support efforts and partnerships conducive to the achievement of gender
equality, social justice and equal participation in the current democratic transition.
It is hoped that this report will serve as a reference document for the three countries and for
other countries in similar stages of democratic transitions.
